PLEDGE OF ALLEGIANCE

ROLL CALL

PRESENT:         Councilmembers Mark Nexsen, Dean Barlow, Lee Barnes, Don Callahan, David McAtlin, Margaret Nyberg, and Brian Wedemeyer.

CALL TO THE PUBLIC

Mr. Nic Jones said that he and his daughter, Gabriella Jones, are asking the council for their support in allowing Gabriella to swim at the Aquatic Center pool during the morning session before she goes to school. Mr. Jones explained that he grew up in Lake Havasu City and after graduating from Lake Havasu High School, he went to Northern Arizona University, got married, and then decided to move back to Lake Havasu City because he and his wife felt that it was the best place to raise their children.

Mr. Jones explained that his daughter is nine years old, and the only opportunity for her to lap swim at the Aquatic Center is before school from 5:00 a.m. to 7:00 a.m., but the early morning classes changed to adults only. He clarified, however, that the article in the newspaper incorrectly reported that Gabriella was under doctor’s orders to swim, and that it is actually he who has a medical situation requiring low-impact exercise. He said that he and Gabriella have been swimming together for more than a year, and when using the pool, he and his daughter do not play and splash around, but swim in only one lane with Gabriella either directly in front of or directly behind him. Mr. Jones said he is not sure why his daughter has been banned from swimming with him, and why as of January 1, 2009, lap swimmers in the early morning must be at least 18 years old.

Mr. Jones said he called and left messages with the city department directors, but he has not received any replies. He said he also spoke with Mayor Nexsen a couple of times, but there is still no resolution to this situation. Mr. Jones would like for his daughter to be allowed to lap swim with him during the morning session. He also said that Gabriella does not understand why she is not allowed to swim with her father. He said he would like Gabriella to be allowed to lap swim with him in the 5:00 a.m. to 7:00 a.m. spring session at the Aquatic Center.
